Succinct Statement
Must display this statement:
"2,000 calories a day is used for general nutrition advice, but calorie needs vary."
Placement on a menu board: at the bottom of the menu board, immediately above, below or beside the statement of availability. It must be posted prominently, in a type size no smaller than the smallest calorie declaration on the same board, in the same color (or one at least as conspicuous) and with at least the same contrast (21 CFR 101.11(b)(2)(i)(B)(1) and (3)). On a printed menu it goes at the bottom of each page; on an ordering kiosk that functions as a menu, FDA says it should appear on each screen (Labeling Guide Part II, Q&A 5.70).
Statement of Availability
Must also display this statement, on all forms of the menu or menu board:
"Additional nutrition information available upon request."
Placement on a menu board: at the bottom of the menu board, immediately above, below or beside the succinct statement, with the same type-size, color and contrast rules (21 CFR 101.11(b)(2)(i)(C)(1) and (3)). On a printed menu it only needs to appear at the bottom of the first page with menu items; on an ordering kiosk that functions as a menu, only on the first screen with standard menu items (Labeling Guide Part II, Q&A 5.55 and 5.71).
Separate sign: self-service food only. For self-service foods and foods on display (buffets, salad bars, grab-and-go cases), both statements may go on a sign adjacent to the food, on a separate larger sign in close proximity that customers can read while choosing, or on a large menu board (21 CFR 101.11(b)(2)(iii)(B); FDA Menu Labeling: Supplemental Guidance for Industry, May 2018, Q&A 3.5 and 3.6). The regulation offers no separate-sign alternative for the menu board itself.

FDA: calories "may not be listed on a webpage or screen that is separate from the associated menu item" (Labeling Guide Part II, Q&A 5.23).
Where the Two Statements Go on a Rotating Board
FDA answers this directly in A Labeling Guide for Restaurants and Retail Establishments Selling Away-From-Home Foods, Part II (Menu Labeling Requirements in Accordance with 21 CFR 101.11), April 2016, Q&A 5.49 (fda.gov/media/93414/download):
- "The succinct statement and the statement of availability need only appear on rotating displays of such digital menu boards that list standard menu items." A panel that shows only a promotion or a brand video, with no standard menu items, does not need them.
- Every panel that does list standard menu items carries both statements at the bottom, visible to customers while they place their order (21 CFR 101.11(b)(2)(i)(B)(3) and (C)(3)). Showing them once at the start or end of the loop does not meet this.
- With several digital menu boards that rotate, the statements "should appear on each rotating display of each digital menu board that lists standard menu items."
- A multi-panel board whose panels are all visible at once while ordering counts as a single menu board, so the statements appear once, at its bottom.
The simplest implementation is a fixed footer zone holding both statements on every layout that lists menu items.
